TERMS OF SERVICE

1. AGREEMENT
These Terms of Service govern access to and use of the PLUÜM website, store, content, products, and related services. “PLUÜM,” “we,” “us,” and “our” refer to PLUÜM. By accessing the store or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the services.

2. ELIGIBILITY AND ACCOUNT INFORMATION
You must be the age of majority in your jurisdiction to make a purchase. Information provided at checkout must be current, complete, accurate, and authorized. You are responsible for account credentials and activity associated with your account.

3. PRODUCTS AND SUPPLIER-DIRECT FULFILLMENT
PLUÜM curates and retails products that may be manufactured, stocked, packaged, shipped, serviced, warranted, or accepted for return by independent suppliers and manufacturers. Product availability, specifications, finishes, colors, dimensions, lead times, components, and packaging can change. Screen settings and natural materials can cause appearance variations.

Supplier and manufacturer terms applicable to a particular product—including availability, shipping area, delivery method, cancellation, return eligibility, restocking, warranty, installation, and service requirements—are incorporated into the sale. If a product page, written quotation, or order-specific notice contains stricter terms, those terms control to the extent permitted by law.

4. ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase. An automated confirmation only confirms receipt and does not guarantee acceptance or availability. PLUÜM may accept, reject, hold, correct, or cancel an order because of inventory changes, supplier rejection, pricing or description errors, suspected fraud, destination restrictions, or inability to fulfill. If a paid order is not accepted, the applicable amount will be refunded to the original payment method.

Review product dimensions, access requirements, utilities, installation needs, local codes, permits, and delivery restrictions before ordering. Customer-requested cancellations are not guaranteed after supplier acceptance, production, or shipment and are governed by our Return and Refund Policy.

5. PRICES, PAYMENT, TAXES, AND FRAUD REVIEW
Prices and promotions may change without notice. The price in the accepted order controls. Unless expressly stated, product prices exclude shipping, handling, taxes, duties, permits, installation, site preparation, and special delivery services. You authorize PLUÜM and its payment providers to charge the amounts shown at checkout and any later customer-approved service charge.

PLUÜM may request identity, address, or payment verification and may delay or cancel an order that presents fraud, payment, resale, export, or compliance concerns.

6. SHIPPING, DELIVERY, TITLE, AND RISK
Shipping and delivery are governed by our Shipping Policy. Independent suppliers and carriers control fulfillment and transit. Delivery dates are estimates, not guarantees. Multiple suppliers may create separate shipments and delivery dates.

To the extent permitted by law, title and risk of loss pass as provided by the applicable supplier, carrier terms, and governing law. This provision does not eliminate any non-waivable consumer right or a valid claim for a damaged, defective, missing, or incorrect product. The customer must inspect freight, document exceptions, retain packaging, and report issues within the time stated in our Shipping Policy.

7. RETURNS, REFUNDS, CANCELLATIONS, AND WARRANTIES
Returns, refunds, cancellations, exchanges, freight claims, and restocking charges are governed by our Return and Refund Policy and the applicable supplier or manufacturer terms. No return is authorized until PLUÜM provides written approval and instructions.

Unless PLUÜM expressly provides a separate written warranty, product warranties are limited to warranties offered by the applicable manufacturer or supplier. Warranty eligibility, duration, remedies, exclusions, parts, labor, shipping, and service are determined by that warranty provider. PLUÜM will reasonably assist in directing an eligible claim but does not expand a third party's warranty.

8. INSTALLATION, USE, HEALTH, AND SAFETY
Products such as kitchens, grills, fireplaces, saunas, spas, structures, electrical products, gas products, plumbing fixtures, and large furniture can require licensed installation, permits, site preparation, anchoring, ventilation, utility work, or professional inspection. The customer is responsible for safe installation, maintenance, use, local-code compliance, and following all manufacturer instructions and warnings.

Wellness information and product descriptions are not medical advice. Consult a qualified healthcare professional before using a sauna, spa, cold plunge, or similar wellness product if you have a medical condition, are pregnant, take medication, or have safety concerns.

9. INTELLECTUAL PROPERTY
The store design, PLUÜM name and branding, text, graphics, and original content are owned by or licensed to PLUÜM and are protected by applicable intellectual-property laws. Manufacturer and supplier names, marks, product content, and media belong to their respective owners. You may use the store only for lawful personal shopping and may not copy, scrape, republish, exploit, interfere with, or bypass security measures without written permission.

10. THIRD-PARTY SERVICES AND LINKS
The store can include third-party applications, payment services, financing, carriers, supplier content, and links. Their services and terms are controlled by those third parties. PLUÜM is not responsible for third-party websites or services except to the extent required by law.

11. RELATIONSHIP WITH SHOPIFY
PLUÜM is powered by Shopify, which enables us to provide the store services. Sales and purchases made through this store are directly between the customer and PLUÜM. Shopify is not the seller and is not responsible for the products, fulfillment, or transactions between the customer and PLUÜM.

12. PROHIBITED USE
You may not use the services unlawfully; infringe another party's rights; submit false, harmful, abusive, or fraudulent information; transmit malicious code; interfere with store security or operation; scrape or extract store content without permission; impersonate another person; or use the services to violate export, sanctions, consumer, safety, or other applicable laws.

13. DISCLAIMER
To the fullest extent permitted by law, and except for any express written warranty that cannot be disclaimed, the services and products are provided “as is” and “as available.” PLUÜM does not guarantee uninterrupted store access, error-free content, continuous product availability, or delivery by an estimated date. Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply.

14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, PLUÜM and its owners, personnel, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, lost profits, lost use, lost data, or project delay arising from the services or products. Where liability cannot be excluded, PLUÜM's aggregate liability will not exceed the amount paid to PLUÜM for the product or order giving rise to the claim. This section does not limit liability that applicable law does not allow us to limit.

15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold PLUÜM harmless from third-party claims and reasonable costs arising from your unlawful use of the services, violation of these Terms, misuse or unauthorized modification of a product, or violation of another party's rights.

16. GOVERNING LAW; SEVERABILITY
These Terms are governed by the laws applicable in Oregon, United States, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise. If a provision is unenforceable, it will be limited or severed and the remaining provisions will continue. Failure to enforce a provision is not a waiver.

17. CHANGES
We may update these Terms by posting a revised version and effective date. Material changes apply prospectively as required by law. Continued use after an effective update constitutes acceptance of the revised Terms.
